These Terms of Service ("Terms") govern your use of HotelCompass ("the Platform"), a hospitality intelligence and advisory platform operated by HotelCompass, a company incorporated in the Republic of Kenya. By creating an account or accessing the Platform, you agree to be bound by these Terms.
HotelCompass provides financial modelling, market intelligence, operator matching, bill-of-quantities tooling, advisory services and related AI-powered outputs for hospitality professionals, developers, investors and consultants. You may use the Platform only for lawful business purposes consistent with these Terms.
You agree to provide accurate, current and complete information during registration and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Accounts found to be misused, shared, or used for automated scraping may be suspended without notice.
Paid plans grant access to premium tooling and downloads. Free trial access is feature-gated as indicated in the pricing page. Subscription fees are billed in the currency shown at checkout and are non-refundable except where required by applicable law. We reserve the right to adjust pricing on 30 days' notice.
The Platform incorporates AI-assisted analysis. All AI outputs are decision-support materials only and are not a substitute for professional financial, legal, or construction advice. You accept full responsibility for any decisions made on the basis of Platform outputs, including but not limited to feasibility studies, BOQ comparisons, valuation estimates and funding advisory content.
HotelCompass and its licensors retain all rights in the HotelCompass Platform, its code, databases, benchmark data, templates and branding. You retain all rights in the project data you submit. You grant us a limited licence to process your data for the purpose of delivering the Platform to you.
To the maximum extent permitted by law, our total liability for any claim relating to the Platform is capped at the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, consequential or lost-profit damages.
Either party may terminate the relationship on 30 days' notice. We may suspend access immediately for material breach. On termination you may export your data for 30 days; thereafter data may be deleted from active systems.
These Terms are governed by the laws of the Republic of Kenya. Disputes shall be resolved by the courts of Mombasa, Kenya, save that either party may seek injunctive relief in any competent jurisdiction to protect intellectual property or confidential information.
